Export Control and Controlled Information Notice

DERECHO works in defense technology. Some of what we do is subject to United States export control and sanctions law. This notice explains what that means for visitors to this website, and what not to send us.
1. This Website Contains Public-Release Information Only
This is a marketing and general corporate information website. Content on it is intended for public release and presents representations of research and development at a summary level. We do not publish classified information, Controlled Unclassified Information, or export-controlled technical data here, and this website does not host, store, or provide access to any such material. No specification, interface detail, performance data, or other technical data beyond general public descriptions is available on or through this website.
2. Public Availability Does Not Establish Classification
The fact that information appears on this public website does not determine, establish, or evidence its export classification, and does not mean that related information is uncontrolled. Classification depends on the specific item, data, or service and on the applicable regulation, not on where a summary description happens to appear.
3. Some Materials May Be Controlled
Certain DERECHO products, components, software, source code, technical data, services, and future materials may be subject to the Arms Export Control Act and the International Traffic in Arms Regulations, to the Export Administration Regulations, or to economic sanctions administered by the United States government.
We do not classify any product in this notice. Classification and licensing determinations are fact-specific and are handled through authorized channels.
4. Access Does Not Grant a License
Visiting this website, downloading a public document from it, or corresponding with us does not grant any export license, authorization, exemption, or exception.
5. No Authorization to Export or Transfer
Nothing on this website authorizes any person to export, reexport, retransfer, release, or otherwise provide any controlled item, technical data, software, source code, or service to any person or destination.
6. Your Obligation to Comply
Visitors are responsible for complying with applicable United States export control and sanctions law, and with the law of their own jurisdiction. This includes restrictions on dealings with sanctioned countries, entities, and individuals.
7. Foreign-Person Access
Under United States law, releasing controlled technical data to a foreign person can constitute an export, including when that person is physically inside the United States and including when the release is oral or visual.
For this reason, access to certain DERECHO information, facilities, meetings, and materials may require verification of a person's status and, in some cases, a government authorization. If you are seeking information beyond what is published here, expect us to ask.
8. Do Not Submit Classified Information or CUI
Do not submit classified information or Controlled Unclassified Information through this website, through any website form, or by ordinary email.
9. Do Not Submit Export-Controlled Technical Data
Do not submit export-controlled technical data through this website or by ordinary email, whether as an attachment, in a message body, or in a link to a file.
10. Do Not Submit Source Code
Do not submit source code subject to access restrictions, or links to repositories containing it.
11. Do Not Submit Third-Party Proprietary Information
Do not submit proprietary or trade secret information belonging to another party, or information covered by another party's non-disclosure agreement, unless you are clearly authorized to disclose it to us.
12. Do Not Submit Procurement-Sensitive Information
Do not submit source selection information, contractor bid or proposal information, or other procurement-sensitive material.
13. Requesting an Approved Exchange Method
If you need to share material of any of the kinds described above, do not send it first. Send a short message describing the general subject and your organization, without including the sensitive content itself, and we will discuss an appropriate method, which may require a written agreement or a government authorization before any exchange occurs.
14. Employment and Supplier Eligibility
Some roles and some supplier work involve access to export-controlled, classified, or otherwise restricted information. Where that is the case, eligibility for the role or the work may depend on a person's ability to lawfully receive that information, and may require verification or a government authorization.
15. Basis for Access Restrictions
Access restrictions of the kind described in Section 14 arise from legal authorization requirements applicable to controlled information. They are applied for that reason. They are not a basis for discrimination on national origin, citizenship status, or any other protected characteristic, and DERECHO does not apply them as a proxy for any such basis.
16. Not All Products Are Controlled
This notice does not state or imply that every DERECHO product, service, or item of information is subject to the ITAR, the EAR, or any other control. Some may not be controlled at all.
17. No Statement of Registration Status
This notice does not state that DERECHO holds any particular export registration, license, authorization, or approval. Any statement about registration status will be made, if at all, in a specific context where it is verified and appropriate, not on a general public page.
18. No Classification Codes Published
We do not publish USML categories, Export Control Classification Numbers, or license determinations for any product on this website.
